EdgeHaven Hosting Terms of Service

Welcome to EdgeHaven Hosting (“EdgeHaven,” “we,” “us,” or “our”). By accessing our website at edgehavenhosting.com, creating an account, or using our hosting services (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our Service.

1. Acceptance of Terms

By using EdgeHaven, you explicitly agree to these Terms of Service and our Privacy Policy. Your continued use of the Service constitutes a legally binding agreement. We reserve the right to modify these terms at any time, and your continued use following any changes constitutes acceptance of those changes.

2. Relationship with Infrastructure Providers

EdgeHaven provides a managed SaaS hosting layer built upon third-party infrastructure, primarily Cloudflare, Inc.

• Incorporation of Third-Party Terms: As a condition of using EdgeHaven, you agree to comply with the Cloudflare Acceptable Use Policy (AUP) and any other applicable Cloudflare service terms.
• Direct Compliance: Any violation of Cloudflare’s AUP by your content or actions shall be deemed a material breach of these EdgeHaven Terms.

3. Prohibited Use and Content

You are solely responsible for all content published through your EdgeHaven account. You agree not to use the Service for:

• Illegal Acts: Any activity that violates local, state, federal, or international law.
• Abuse and Malware: Distributing viruses, worms, malware, or participating in DDoS attacks or phishing schemes.
• Prohibited Material: Hosting content that is defamatory, infringing on intellectual property, or violates the rights of others.
• Resource Abuse: Attempting to bypass EdgeHaven’s portal to access underlying infrastructure directly or using the service in a way that creates an undue burden on our systems or Cloudflare’s network.

4. Intellectual Property

• Your Content: You retain all ownership rights to the content you upload to EdgeHaven. By using the Service, you grant us a limited, non-exclusive license to host, cache, and display your content solely for the purpose of providing the Service.
• EdgeHaven Property: All software, portal designs, logos, and trademarks associated with EdgeHaven remain our exclusive property.

5. Account Security and Access

You are responsible for maintaining the confidentiality of your EdgeHaven portal credentials. You agree to notify us immediately of any unauthorized use of your account. EdgeHaven is a managed service; you are prohibited from attempting to access our underlying Cloudflare dashboard or system-level configurations.

6. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without notice, if:

• You violate these Terms or the Cloudflare AUP.
• We receive a valid legal request or DMCA takedown notice regarding your content.
• Your usage poses a security risk to our infrastructure or other users.

7. Limitation of Liability and Warranty

THE SERVICE IS PROVIDED "AS IS." EDGEHAVEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL EDGEHAVEN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING OUT OF YOUR USE OF THE SERVICE OR ANY DOWNTIME CAUSED BY THIRD-PARTY INFRASTRUCTURE PROVIDERS.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
